Terms of Service

1. Acceptance of Terms

By accessing and using Spendflip ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use Spendflip. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Spendflip is a personal savings goal tracking application that helps users set savings goals and log transactions representing everyday spending decisions. Users can record three types of transactions: "Cheaper" (logging savings from choosing a less expensive alternative), "No Buy" (logging savings from deciding not to purchase an item), and "Withdrawal" (subtracting funds from a goal's progress). The app provides analytics and visualizations to help users track their savings progress over time. The Service is provided on an "as is" and "as available" basis. Spendflip does not provide financial, investment, tax, or legal advice.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit harmful, threatening, or illegal content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service's operation
• Use the Service for any commercial purpose without permission

5. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nimbus Foundry, LLC and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

8. Limitation of Liability

In no event shall Nimbus Foundry, LLC, nor its members, managers, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Spendflip expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Subscriptions and Billing

Spendflip offers both a free tier and a premium subscription tier:

• Free Tier: Up to 2 savings goals, 5 transactions per day, and 30 days of analytics history.
• Premium Tier: Up to 100 savings goals, 100 transactions per day, unlimited analytics history, and CSV and PDF data export.

Premium subscriptions include a 7-day free trial. After the trial period, your selected subscription plan will be billed through the Apple App Store or Google Play Store, depending on your platform. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription through your Apple App Store or Google Play Store account settings. Refund requests are subject to the refund policies of Apple or Google, as applicable.

12. Third-Party Platform Terms

Your use of Spendflip is also subject to the terms and conditions of the platform through which you access the app, including the Apple App Store Terms of Service and Google Play Terms of Service. Additionally, the app uses Firebase (Google) for authentication and RevenueCat for subscription management, each governed by their own terms of service.

13. Changes to Terms

We reserve the right to modify these Terms. If a revision is material, we will provide at least 30 days' notice before any new terms take effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
